1. Information for the user
Who is the controller of your personal data?
DULASPORT SL (Tax ID B75932913, Calle Creativitat, 4B, 08850 Gavà, Barcelona, Spain; dulasport2025@gmail.com) is the CONTROLLER of the USER's personal data and informs the USER that these data will be processed in accordance with Regulation (EU) 2016/679 of 27 April (GDPR) and Spanish Organic Law 3/2018 of 5 December (LOPDGDD).
Why do we process your personal data?
To maintain a commercial relationship with the user. The processing operations envisaged are:
- Sending commercial and advertising communications by e-mail, fax, SMS, MMS, social networks or any other electronic or physical means, present or future, that makes it possible to send commercial communications. These communications will be sent by the CONTROLLER and will relate to its products and services, or those of its partners or suppliers with whom it has reached a promotional agreement. In this case, third parties will never have access to the personal data.
- Carrying out market research and statistical analyses.
- Processing orders, assignments and requests, and answering queries or any type of request made by the USER through any of the contact methods made available on the CONTROLLER's website.
- Sending the online newsletter about news, offers and promotions in our business.
On what grounds may we process your personal data?
Because the processing is lawful under Article 6 of the GDPR as follows:
- With the USER's consent: sending commercial communications and the newsletter.
- For the performance of a contract to which the USER is party or in order to take steps at the USER's request prior to entering into a contract: processing the USER's orders, assignments and requests.
- For compliance with the CONTROLLER's legal obligations (for example, tax and accounting obligations).
- For the CONTROLLER's legitimate interest: carrying out market research, statistical analyses, etc.
- For the CONTROLLER's legitimate interest in direct marketing to its own customers (Recital 47 of the GDPR and Article 21.2 of Spanish Law 34/2002 on Information Society Services and Electronic Commerce): sending commercial communications about its own products similar to those previously purchased by the customer, where the contact details were lawfully obtained in the context of that purchase. The customer may object to this processing, easily and free of charge, both when the data are collected and in each commercial communication received.
How long will we keep your personal data?
They will be kept for no longer than necessary to fulfil the purpose of the processing or for as long as legal requirements oblige us to retain them, and when they are no longer needed for that purpose they will be deleted with appropriate security measures to ensure the anonymisation of the data or their complete destruction.
To whom do we disclose your personal data?
No disclosure of personal data to third parties is envisaged except, where necessary for the performance of the purposes of the processing, to our service providers (for example, communications, payment and transport providers for the delivery of orders), with whom the CONTROLLER has signed the confidentiality and data processing agreements required by current privacy legislation, and except where required by law.
International transfers: Some providers process data outside the European Economic Area: Shopify, Klaviyo, Google, Meta, Microsoft, OpenAI and TikTok (United States or Canada), UpPromote and 4Seller. These transfers rely on the EU-US Data Privacy Framework where the provider is certified and, otherwise, on the standard contractual clauses approved by the European Commission. What are your rights?
The USER has the following rights:
- The right to withdraw consent at any time.
- The right of access, rectification, portability and erasure of their data, and the right to restriction of or objection to their processing.
- The right to lodge a complaint with the supervisory authority (www.aepd.es) if they consider that the processing does not comply with current legislation.

2. Mandatory or optional nature of the information provided by the user
USERS, by ticking the corresponding boxes and entering data in the fields marked with an asterisk (*) in the contact form or in download forms, expressly, freely and unequivocally accept that their data are necessary for the provider to deal with their request, the inclusion of data in the remaining fields being optional. The USER guarantees that the personal data provided to the CONTROLLER are accurate and is responsible for notifying any changes to them.
The CONTROLLER informs that all data requested through the website are mandatory, as they are necessary to provide an optimal service to the USER. If not all the data are provided, there is no guarantee that the information and services provided will be fully tailored to their needs.
3. Security measures
In accordance with current personal data protection legislation, the CONTROLLER complies with all provisions of the GDPR and the LOPDGDD for the processing of the personal data for which it is responsible, and in particular with the principles set out in Article 5 of the GDPR, under which data are processed lawfully, fairly and transparently in relation to the data subject and are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.
The CONTROLLER guarantees that it has implemented appropriate technical and organisational policies to apply the security measures established by the GDPR and the LOPDGDD in order to protect the rights and freedoms of USERS, and has provided them with appropriate information so that they can exercise them.
